Resolution: | WHEREAS third-party infrastructure and developments on private farmland, including power-lines, pipelines, and wells, are governed under various pieces of legislation with different rules; WHEREAS it is not always possible for agricultural producers to be compensated for the cost of having these developments on their land, even when evidence of loss of use or nuisance can be provided; WHEREAS safety and liability issues are a concern for agricultural producers whose property is used for third-party infrastructure and developments; BE IT RESOLVED that APAS call for legislative changes to ensure agricultural producers can seek compensation when third-party infrastructure is impacting the productivity and efficiency of their land and farming operations. |
